Lease Term
This Lease Agreement will be in effect for three (3) years.
Lease Equipment
The equipment referred to in this Lease Agreement consists of the equipment package listed above.
For the purpose of this document, all of these items are referred to collectively as the ‘Device’. Each Device will be:
protected by anti-virus tools and automated updates
able to be used at home and at school for student learning
installed with the College’s standard suite of software
Fees and Charges
Fee for the Provision of Device
Parents/carers are required to pay an annual user fee, charged to annual school fees. This will cover costs incurred by the school in providing and supporting the Device.
The Device hire is charged annually to school fees. Charges are covered under The King’s College Debt Collection Policy, which should be read in conjunction with this Agreement.
Parents are encouraged to refer to the Payment Options Form issued with their annual school fees to ensure they are aware of the minimum periodic payments required to have their accounts paid by the due dates.
Where an account is referred to the College appointed debt recovery agency, AMPAC, for non-payment, the College reserves the right to terminate the Lease Agreement and take possession of the Device and accessories. The school account will be adjusted to reflect the return of equipment.
If a student commences at the College after week four of Term One, the Device hire fees will be charged pro-rata in the first year. Full fees will be charged in the second and third year.
If the student departs the College during the term of the agreement, the fee for the relevant year will be charged pro-rata based on the departure date. For example, if the student leaves in June 2024, the hire fees relating to the period from February to June 2024 will be payable and hire fees for 2025 and 2026 will not be charged. If the Device is not returned within two (2) weeks of the departure date, hire fees will be charged for the period up until the Device and accessories are returned to the College.
Equipment Ownership
The Device and accessories remain the property of The King’s College unless a buy-out price has been agreed upon in writing and paid to the College by the parent/carer.
Device Care
The student is responsible for taking care of and securing the Device and accessories in accordance with school policy and guidelines.
The Device should be fully charged for the start of each school day.
It is the responsibility of the parent/carer to ensure that reasonable care is taken in the storage and use of the Device.
Insurance
Accidental Damage
All device repairs are to be undertaken via the IT Department of the College.
In the case of accidental damage to the device, a parent/carer will need to lodge an insurance claim form and hand it into Reception or IT Support together with the nominated excess payment.
On receipt of the necessary documentation and excess payment, The King’s College will initiate repairs.
The device will not be issued for repair or returned to the student until the excess or full payment as applicable, has been received by the College.
Intentional Device Damage
Intentional damage is when damage is not classified as accidental damage. The King’s College does not cover the Device for any intentional damage, careless damage, or negligence. Examples of items not covered are:
Any buttons/keys being removed from the Device’s keyboard due to excessive force applied.
Leaving the Device unattended and as a result, it was damaged by someone or something else other than the user or assigned owner.
No explanation whatsoever can be provided for how the resulting damage occurred.
Repeating cases for the same Device which may have previously been termed as accidents.
When a Device is deemed damaged as a result of wilful damage, careless damage or negligence, parents may be required to pay the full replacement cost of the Device.
Theft and Loss
In the case of loss or suspected theft, a parent/carer will need to lodge a report with the nearest police station. It is important that the following be recorded and provided to the school IT Department
within 10 days of theft or loss:
In both cases, an insurance claim form must be provided to the school.
On receipt of the necessary documentation, The King’s College will initiate recovery procedures via inbuilt theft protection software. Should a device be unrecoverable, the cost of replacement is a maximum excess as nominated in package.
The Accidental Damage and Theft Cover only provides for one (1) Theft claim under the Theft benefit. Should you have a second theft incident, the insurance policy may not provide further cover.
Claims for loss or theft of a device that is unattended (off school grounds) or not properly secured may not be covered.
The student will not receive a replacement Device until the excess or full payment as applicable, has been received by the College.
Replacement of Accessories
Parents/carers are responsible for the replacement of lost or damaged components and accessories, including the keyboard, case, Apple Pen and charger.
Limits of Liability
The information below outlines the claim limits that apply (net of Excesses) for each type of Cover under the Accidental Damage and Theft Protection Insurance.
The maximum total of all claims payable per device will be the original purchase cost (inclusive of GST) of the covered product.
The College will not accept any liability to you, or any subsequent owner of the Device, for any liability or damages for the Device not being available for use, loss or corruption of data or software, personal injury, death, other indirect loss due to product failure.
Security and Acceptable Use
Data security
Students must understand the importance of backing up data securely. Should the Device develop a fault, assignment work that has taken a considerable time to prepare may be lost.
The student is responsible for the backup of all data. While at school, students can save data to the school’s cloud network which is safeguarded by rigid security protocols. Students are also able to save data locally to the Device for use away from the school network. The backup of this data is the responsibility of the student and should be backed up on an external Device or in a secure cloud location.
It is a requirement of using the Device that students provide authorised school staff with access to the Device and personal holdings associated with the use of the Device if requested.
Students should also be aware that, in the event that any repairs need to be carried out, the data stored on the Device may be deleted and the storage media reformatted.
Acceptable Digital Device and Internet use
The College upholds strict policies regarding acceptable use of ICT. The College ‘
ITC AND INTERNET ACCEPTABLE USE AGREEMENT’ and
‘Student-Parent Device Participation Agreement ’(Please use links) should be read in conjunction with this Agreement.
If there is insufficient storage space on the Device to allow school-related activities, the school reserves the right to delete non-educational content.
Digital Citizenship
Students should be conscious creators of the content and behaviours they exhibit online and take active responsibility for building a positive online reputation. They should be conscious of the way they portray themselves and the way they treat others online.
Students should be mindful that the content and behaviours they have online today are easily searchable and accessible. This content may form a permanent online record into the future. Interactions within digital communities and environments should mirror normal interpersonal expectations and behavioural guidelines, such as when in a class or the broader community.
Parents are requested to ensure that their child understands this responsibility and expectation.
Cyber-safety
If the student believes they have received a computer virus or spam (unsolicited email), or if they have received a message that is inappropriate or makes them feel uncomfortable, they must inform their teacher, parent/caregiver as soon as is possible.
Students must seek advice if another user seeks personal information, asks to be telephoned, offers gifts by email or asks to meet a student.
Students must never initiate or knowingly forward emails, or other messages, containing:
A message sent to them in confidence.
A computer virus or attachment that is capable of damaging the recipient’s computer.
Chain letters or hoax mails.
Spam (such as unsolicited advertising).
Students must never send or publish:
Unacceptable or unlawful material or remarks, including offensive, abusive or discriminatory comments.
Threats, bullying or harassment of another person.
Sexually explicit or sexually suggestive material or correspondence.
False or defamatory information about a person or organisation.
Filtered Internet Use
An internet filtering protection solution provides the school with the ability to restrict access to inappropriate material on the College's ICT network. When students are connected through the school’s managed network, they will have a high level of filtering applied, as deemed appropriate by the College. The College does not provide web filtering outside of the College premises.
Privacy and Confidentiality
It is important that students do not publish or disclose the email address of a staff member or student without that person’s explicit permission.
The student should not reveal personal information including names, addresses, photographs, credit card details or telephone numbers of themselves or others.
It should also be ensured that privacy and confidentiality is maintained by not disclosing or using any information in a way that is contrary to any individual’s interest.
Intellectual Property and Copyright
Students should never plagiarise information and shall observe appropriate copyright clearance, including acknowledging the original author or source of any information used. It is also important that the student obtain all appropriate permissions before electronically publishing other people’s works or drawings. The creator or author of any material published should always be acknowledged.
Material being published on the internet or intranet must have the approval of the principal or their delegate and have appropriate copyright clearance.
Misuse and Breaches of Acceptable Usage
Students should be aware that they are held responsible for their actions while using the internet and online communication services. Students will be held responsible for any breaches caused by other person(s) knowingly using their account to access the internet and online communication services.
The misuse of the internet and online communication services may result in disciplinary action, which includes, but is not limited to, the withdrawal of access to services.
Where Australian Law is broken, the school will refer the matter to Western Australian Police.
Software & Applications
The software loaded on the Device is licensed to The King’s College. The parent/carer must ensure that the software is not copied, deleted or transferred without prior written consent from the school. Unauthorised use may breach copyright laws, and the parent/carer may be held liable for any damages incurred.
Parents/carer, at their discretion, may create their own iCloud account and Apple ID for the Device and purchase/install additional applications (apps). The school accepts no responsibility for the support of these applications.
Parents/caregivers are strongly advised to be mindful of the suitability of any apps that they install and to provide adequate supervision of the Device’s usage, particularly in relation to cyber safety.
Monitoring and Reporting
Students must be aware that all use of the internet and online communication services can be audited and traced to the account of the user.
All material on the Device is subject to review by authorised school staff. If at any stage there is a police request, the school will provide the authorities with access to the Device and personal holdings associated with the use of the machine.
Students’ Reporting Requirements
Students are required to report any internet site accessed that is considered inappropriate.
Any suspected security breach involving students, users from other schools, or from outside the network must also be reported to the school.
End of Agreement Period
At the end of the three-year lease period all Devices and accessories are to be returned to The King’s College in good working order by the date specified on the Lease Agreement. A receipt for the return will be issued.
Parents may request to purchase the Device from the school at the end of the 3 Year Lease Agreement period. The buyout figure will be established by the College’s Finance department, which will acquire a buyout price from the supplier. Any Devices not being purchased by the parents will be cleared of any data and returned to the supplier.
If the student’s enrolment is terminated by either party during the term of the Lease Agreement period:
the Device and accessories must be returned to the school on the final day of school.
if the Device and accessories are not returned within two weeks of the termination date, attempts by school staff requesting the return of the Device will be made. If attempts are unsuccessful, it will be deemed stolen property and escalated to Western Australian Police.
