Lease Term
This Lease Agreement will be in effect for three (3) years.
Lease Equipment
The equipment referred to in this Lease Agreement consists of the equipment package listed above.
For the purpose of this document, all of these items are referred to collectively as the ‘Device’. Each Device will be:
protected by anti-virus tools and automated updates
able to be used at home and at school for student learning
installed with the College’s standard suite of software
Fees and Charges
Fee for the Provision of Device
Parents/carers are required to pay an annual user fee, charged to annual school fees. This will cover costs incurred by the school in providing and supporting the Device.
The Device hire is charged annually to school fees. Charges are covered under The King’s College Debt Collection Policy, which should be read in conjunction with this Agreement.
Parents are encouraged to refer to the Payment Options Form issued with their annual school fees to ensure they are aware of the minimum periodic payments required to have their accounts paid by the due dates.
Where an account is referred to the College appointed debt recovery agency, AMPAC, for non-payment, the College reserves the right to terminate the Lease Agreement and take possession of the Device and accessories. The school account will be adjusted to reflect the return of equipment.
If a student commences at the College after week four of Term One, the Device hire fees will be charged pro-rata in the first year. Full fees will be charged in the second and third year.
If the student departs the College during the term of the agreement, the fee for the relevant year will be charged pro-rata based on the departure date. For example, if the student leaves in June 2025, the hire fees relating to the period from February to June 2025 will be payable and hire fees for 2026 and 2027 will not be charged. If the Device is not returned within two (2) weeks of the departure date, hire fees will be charged for the period up until the Device and accessories are returned to the College.
Equipment Ownership
The Device and accessories remain the property of The King’s College unless a buy-out price has been agreed upon in writing and paid to the College by the parent/carer.
Device Care
The student is responsible for taking care of and securing the Device and accessories in accordance with school policy and guidelines. Graffiti on the case is strictly prohibited.
The Device should be fully charged for the start of each school day.
It is the responsibility of the parent/carer to ensure that reasonable care is taken in the storage and use of the Device.
Insurance
Accidental Damage
All device repairs are to be undertaken via the IT Department of the College.
In the case of accidental damage to the device, a parent/carer will need to lodge an insurance claim form and hand it to Reception or IT Support together with the nominated excess payment.
On receipt of the necessary documentation and excess payment, The King’s College will initiate repairs.
The device will not be issued for repair or returned to the student until the excess or full payment, as applicable, has been received by the College.
Intentional Device Damage
Intentional damage is when damage is not classified as accidental damage. The King’s College does not cover the Device for any intentional damage, careless damage, or negligence. Examples of items not covered are:
Any buttons/keys are being removed from the Device’s keyboard due to excessive force being applied.
Leaving the device unattended and, as a result, damaged by someone or something else other than the user or assigned owner.
No explanation whatsoever can be provided for how the resulting damage occurred.
Graffiti on the device and case (i.e.engraving, writing, stickers, etc.)
Repeating cases for the same Device which may have previously been termed as accidents.
When a Device is deemed damaged as a result of wilful damage, careless damage or negligence, parents may be required to pay the full replacement cost of the Device.
Theft and Loss
In the case of loss or suspected theft, a parent/carer will need to lodge a report with the nearest police station. It is important that the following be recorded and provided to the school IT Department
within 10 days of theft or loss:
In both cases, an insurance claim form must be provided to the school.
On receipt of the necessary documentation, The King’s College will initiate recovery procedures via inbuilt theft protection software. Should a device be unrecoverable, the cost of replacement is a maximum excess as nominated in the package.
The Accidental Damage and Theft Cover only provides for one (1) Theft claim under the Theft benefit. Should you have a second theft incident, the insurance policy may not provide further cover.
Claims for loss or theft of a device that is unattended (off school grounds) or not properly secured may not be covered.
The student will not receive a replacement Device until the excess or full payment, as applicable, has been received by the College.
Replacement of Accessories
Parents/carers are responsible for the full replacement of lost or damaged components and accessories, including the keyboard, case, Apple Pen and charger.
Limits of Liability
The information below outlines the claim limits that apply (net of Excesses) for each type of Cover under the Accidental Damage and Theft Protection Insurance.
The maximum total of all claims payable per device will be the original purchase cost (inclusive of GST) of the covered product.
The device is not covered if taken outside of Australia.
The College will not accept any liability to you, or any subsequent owner of the Device, for any liability or damages for the Device not being available for use, loss or corruption of data or software, personal injury, death, other indirect loss due to product failure.
End of Agreement Period
At the end of the three-year lease period all Devices and accessories are to be returned to The King’s College in good working order by the date specified on the Lease Agreement. A receipt for the return will be issued.
Parents may request to purchase the Device from the school at the end of the 3-year lease Agreement period, subject to certain terms and conditions being met. The buyout figure will be established by the College’s Finance department, which will acquire a buyout price from the supplier. Any Devices not being purchased by the parents will be cleared of any data and returned to the supplier.
If the student’s enrolment is terminated by either party during the term of the Lease Agreement period:
the Device and accessories must be returned to the school by the final day of school.
if the Device and accessories are not returned within two weeks of the termination date, attempts by school staff to request the return of the Device will be made. If attempts are unsuccessful, it will be deemed stolen property and escalated to Western Australian Police.
